Terms Of Use For StreetNet
   
  The StreetNet Mobile App helps Users connect to Wifi Hotspots of various partnering ISP's in different areas of India.

Access to and use of StreetNet Hotspots is subject to these Terms of Use (Terms and Conditions). StreetNet may at any time revise these Terms and Conditions. Since you are bound by these Terms and Conditions each time you access and use a Hotspot, you should carefully review these Terms and Conditions each time you do so.

If you do not agree to these Terms and Conditions, you may not access or use this Hotspot.

For the purposes of these Terms and Conditions, any reference to "you" or "your" includes but is not limited to the owner and authorized user of the wireless enabled device used to access this Hotspot.

   
Age and Other Requirements to join StreetNet
   
  Signup in StreetNet requires a user to be of age sixteen (16) or older. It is mandatory for users in their teens to inform their Parents & Guardians when they join StreetNet. StreetNet shall have complete authority to disable or freeze accounts of users who are found to be younger than sixteen. Users shall use only their own valid Mobile no. and not anyone else's Mobile no. to join StreetNet.
   
Connecting to the Hotspot
   
  Each Hotspot location can only support a limited number of users accessing the Hotspot at any one time. StreetNet does not warrant or represent that you will be able to access and/or use the Hotspot immediately or each time you visit a Hotspot. You are responsible for providing your own mobile device (which must be a wireless enabled device) that is capable of accessing a Hotspot with its own power source. StreetNet does not provide power, information technology advice or assistance to any user of the Hotspot. You must not use the Hotspot under any circumstances if you do not have express permission of the lawful owner of the wireless enabled device.

StreetNet does not guarantee that the Hotspot will be compatible with any devices or software which you may use to connect to the Hotspot.
   
Speed and Reliability of the Hotspot
   
  The speed and throughput of each Hotspot will vary depending on a number of factors, including but not limited to: The capabilities of your wireless enabled device; the physical location of the wireless access points within StreetNet; Hotspot user traffic during time of access, general internet congestion, wireless signal interference and the location of your wireless enabled device within StreetNet whilst accessing the Hotspot.

StreetNet will use reasonable endeavours to provide you with a reliable, stable and secure access to the Hotspot but, subject to the Statutory Guarantees referred to below, does not promise that the access to the Hotspot will be continuous, fault-free, secure or accessible. StreetNet advises that this Hotspot access is not suitable for supporting any application or use which requires continuous, fault-free network connectivity or uninterrupted data traffic flow.
StreetNet will use reasonable endeavours to monitor and attend to any Hotspot faults, malfunctions or other problems associated with the Hotspot access but, subject to the Statutory Guarantees, will not be liable if such faults, malfunctions or problems occur with the Hotspot and shall not be obligated to rectify any such faults, malfunctions or problems associated with the Hotspot at all or within any specified timeframe.
   
User Obligations and Limitations
   
  The Hotspot is intended to be used in a fair and "community-minded" manner. To this end, StreetNet may, in its absolute and sole discretion, limit or block certain App / Websites and/or content that you may seek to access whilst using the Hotspot. Without limiting its rights, StreetNet may block or limit access to App / Websites and/or content that StreetNet considers are not "family friendly" or may bring negative exposure or harm to StreetNet's reputation and/or brand. This includes but is not limited to App / Websites and/or content that:
-> could cause StreetNet to be in breach of any law or any code or instrument which governs its conduct or to incur a liability to any third person or entity;
-> could interfere with the integrity and/or performance of the Hotspot or any of StreetNet's other networks or equipment;
-> depicts, alludes to or promotes offensive or illegal behaviour;
-> is offensive or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
-> harasses or advocates harassment of another person;
-> exploits people in a sexual or violent manner;
-> contains nudity, violence, or offensive subject matter or which may contain links to adult App / Websites;
-> promotes conduct that is abusive, threatening, obscene, defamatory or libelous;
-> promotes an illegal or unauthorized copy of another person's copyrighted work (including but not limited to file sharing applications such as Limewire, eDonkey, Napster or any other Bit-Torrent or peer to peer applications);
-> involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging or "spamming";
-> furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
-> contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information; or
-> uses sexually suggestive imagery or any other inappropriate, misleading or deceptive content.
You must comply with all directions issued by StreetNet relating to use and access to a Hotspot.
Access to and use of App / Websites and/or content via the Hotspot is also subject to such App / Websites and/or content passing through the firewalls, anti-virus and other managed security systems prior to the Internet pages being delivered to your wireless enabled device, and which are determined and set in StreetNet's sole discretion.
   
Suspension and Termination
   
  We may immediately suspend, terminate or limit your access to the Hotspot if:
-> you are in breach of these Terms and Conditions;
-> you attempt to manipulate or bypass any limitations of the Hotspot by any means;
-> you behave in a vexatious, illegal, inappropriate, or unsociable manner (whether in StreetNet itself or as a user of the Hotspot);
Enhancing and personalising the services that we offer to you; Administering accounts records;
-> we believe on reasonable grounds that there is a real risk of serious loss or damage to StreetNet or a third party if we do not suspend, terminate or limit your access;
-> there is an emergency; or
-> there is an unusually high use of a Hotspot.
   
Automatic Logging Out
   
  You will automatically be logged-out of the Hotspot if your access to the Hotspot is suspended or terminated by StreetNet in accordance with these Terms and Conditions.

If you are in the process of downloading a file and you are automatically logged-out of the Hotspot, your partially downloaded file will not be saved or recoverable.
Subject to the Statutory Guarantees, StreetNet is not liable for loss of your files or data and recommends that you save your work regularly whilst using the Hotspot and/or take the necessary precautions to prevent such occurrences.
   
Security
   
  The internet is an inherently unsecure communication medium. Whilst StreetNet will use reasonable endeavours to provide secure access through this Hotspot, it cannot guarantee the security of the Hotspot at all times. You are solely responsible for any information or data uploaded, downloaded or otherwise communicated via the Hotspot and you are responsible for keeping all usernames, passwords and other security-based information secure and private at all times.
   
Privacy
   
  StreetNet is committed to safeguarding personal privacy. It recognizes that individuals have a right to control how their personal information is collected and used. StreetNet will only collect, use, hold and disclose your personal information for the purposes of delivering the Hotspot in accordance with applicable legislation, these Terms and Conditions and StreetNet's privacy policy.

By accepting these Terms and Conditions, you agree to StreetNet collecting, holding and disclosing the following information:
-> the answers to any survey questions you provide in order to access the Hotspot;
-> information regarding your web browser type and/or operating system information as used by your wireless enabled device, in order to determine the most effective and/or customized way to display the requested webpage on your device;
-> Your first name, email address and postcode;
-> Location data at StreetNet;
-> the IP and MAC address and IMEI Number along with the handset details of the wireless enabled device that has accessed the Hotspot.

StreetNet is not in any way responsible for the collection, storage, disclosure or use of your personal information by any third party (including but not limited to any App / Website that you access and/or use through the Hotspot). You are solely responsible for checking the terms of use and privacy policy of each App / Website you visit on a case by case basis and determining whether you accept such terms of use and privacy policies.

Intellectual Property
   
  These Terms and Conditions and any pages via which you access a Hotspot may contain material which is subject to intellectual property rights, including copyright. You acknowledge and agree that StreetNet either owns or licenses all such intellectual property rights and that nothing in these Terms and Conditions constitutes a transfer of any intellectual property rights to you. To the extent necessary, StreetNet grants to you a non-exclusive, non-transferable and revocable license to access and use the Hotspot and any related intellectual property rights, subject to these Terms and Conditions.
   
Limitation of Liability
   
  Subject to the Statutory Guarantees, your access to and use of this Hotspot is entirely at your own risk, StreetNet makes no warranties or representations as to the accessibility, security, stability or reliability of this Hotspot and StreetNet specifically disclaims any liability or responsibility for any Hotspot faults, failures or interruptions or the accuracy, timeliness, completeness, security or reliability of any communications (including, without limitation, any transactions) made using the Hotspot.

Subject to the Statutory Guarantees, neither StreetNet nor any other party involved in delivering the Hotspot is liable for any direct, incidental, consequential, indirect, or punitive losses or any loss of profit, revenue or data arising out of your access to, or use of, or inability to use or access, the Hotspot for any reason whatsoever, even if StreetNet has been notified or advised of the possibility of such damages. StreetNet assumes no responsibility, and makes no warranty or representation in relation to, and shall not be liable to you in respect of your use of any third party proprietary software.

Subject to the Statutory Guarantees, StreetNet assumes no responsibility, and shall not be liable for, any damage to, or viruses or other harmful code that may infect your computer or mobile device or other property on account of or in connection with your access to or use of the Hotspot.

StreetNet is not responsible for the content of any App / Website accessed or used via the Hotspot. Your access to and use of any App / Website or network connection whilst using the Hotspot is entirely at your own risk.
   
Indemnity and Release
   
  You agree to indemnify, release and hold harmless, StreetNet and its personnel, employees, agents, representatives and advertisers, from and against all loss, damage, liability, charge, expense or cost (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising from your use of a Hotspot or breach of these Terms and Conditions.

StreetNet is not responsible for any financial or personal loss to members using their StreetNet accounts for business or any other purpose for any reason including but not limited to server down situations and accidental or willful deletion of member accounts and/or contents of said accounts.

StreetNet is not responsible or liable for any monetary losses incurred by users using their accounts for either personal or business, marketing or any other commercial purpose for any reason including but not limited to server malfunction, server crashes or software related problems.
   
FREE Wi-Fi Access
   
  The terms in this section will only apply if you are accessing a free Hotspot at StreetNet. You may utilize the StreetNet free Wi-Fi service for a continuous period of up to 1 hour or such time as decided and changed by StreetNet. After this time, you will automatically be logged-out of the Hotspot but (subject to you being able to access a Hotspot) you may log in again and begin a new session.
   
Privacy Policy
   
  This Privacy Policy (together with our App / Website Terms of Use and any other documents referred to on our App / Website sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. This Privacy Policy also sets out how you can instruct us if you prefer to limit the use of that personal data and the procedures that we have in place to safeguard your privacy.

By using the StreetNet Mobile App (the "App") & www.streetnet.in (the "Website") or submitting information to us, you signify your consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you must not use the App / Website or submit information to us through or in connection with the App / Website or otherwise.
Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
   
Information We May Collect From You
   
  We may monitor visits to the App / Website, in order principally, to ensure that it is easy to navigate, identify the areas that are of particular interest to visitors and generally improve the App / Website and services offered. The information we collect in this process will not identify you as an individual and it does not seek to identify individual visitors unless they volunteer their contact details through one of the forms on the App / Website.

In some circumstances our records may identify organizations visiting the App / Website and we may use that information in managing its relationship with those organizations, for example, in considering how to develop the services that it offers.

The personal information StreetNet holds about you will depend on the services you request from StreetNet and the use that you make of those services.
   
We may collect:
   
  Information regarding your use of our services including but not limited to telephone numbers, SMS, MMS, emails and other electronic communications received or made by you and the date, time, cost and duration, of such communications, your browsing history (including web sites you visit) and location data, internet PC location for broadband, address location for billing, delivery, installation or your phone location;
In some circumstances our records may identify organizations visitinformation that you provide by filling in forms and submitting information over the phone, by post, email, fax or on the App / Website. This includes information provided on registration for any one of our services, through surveys, by posting material on the App / Website or by requesting services from us;
Records of communications between you and us relating to services provided by us to you. If you contact us, whether through the App / Website or otherwise (for example, by post, email, fax, phone, text message) we may keep a record of that correspondence. For example, if you submit a query, a complaint, report a problem with our service or App / Website, or otherwise liaise with our customer service,
technical support or any other department in our company we may keep such record; Your debit or credit card details;
Your account name and account numbers held by financial institutions from which your payments for services provided by us are made;
Information obtained as a result of credit checks which you authorize us to carry out; Records of use made by you of services provided by us to you;
Calling line identification/connection logs when you connect to our remote access servers;
Your IP address (this is your computer's individual identification number for internet connection) is automatically logged by our web server. This is used to note your interest in our App / Website; and Details of your visits to our App / Website (including, but not limited to, traffic data, location data, weblogs and other communication data and the resources that you access.
The above information may include any personal information that relates to and identifies you, including but not limited to your name, date of birth, postal address, e-mail address, telephone number, bank account details, and any other information collected as set out in the above list.

We may check some of the information that you provide against third party databases to confirm that it is accurate.

In some cases, for example where we carry out credit checks or collect information from organizations to which we outsource functions, your personal information will be collected indirectly.

We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
   
How We May Use The Information Collected From You
   
  We may process this information for the purpose of:

Providing you with electronic communications services including, without limitation: (i) provisioning or connecting your service; (ii) network routing; (iii) investigating and fixing faults in relation to the services and (iv) investigating complaints; Following up any payments that you may owe us,
Administering contractual agreements or arrangements necessary to provide services to you;
Informing you about services and events provided or organized by us that may be of interest to you;
Enhancing and personalizing the services that we offer to you; Administering accounts records;
Providing you access to all parts or features of our services or the App / Website; Communicating with you on any matter relating to the provision generally of our services;
Dealing with your inquiries and requests, including contacting you if necessary; Carrying out our obligations arising from any contracts entered into between you and us;
Processing your payment;
Contacting you for your views on our services and notifying you occasionally about important changes or developments to our services or the App / Website;
Carrying out market research campaigns;
Improving and developing our services or the App / Website;
Ensuring that content from our App / Website is presented in the most effective manner for you and for your computer or mobile device;
Performing research and statistical analysis and analyzing markets and producing reports; and
Debt recovery or debt tracing, crime, fraud and money laundering compliance. We may also use your personal information, or permit selected third parties to use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about this by email, post or telephone. If you prefer not to receive information from StreetNet or from its selected third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data, (e.g. the order form or registration form) if applicable, or send an e-mail message to info@streetnet.in at any time.

StreetNet contracts out part of its communications services plus other ancillary services such as mailing, credit checking, provisioning, billing, printing, verification of sales and fault fixing to external service providers. We may disclose your personal information to these organizations but only so that they can provide you with the services that we have contracted out.

We may disclose your personal information to other telecommunications service and equipment providers, StreetNet related corporate bodies, resellers, credit providers, credit reporting agencies, organizations to whom we outsource services, and our business partners and associates. At your request, we may disclose your information to directory providers so that your information can appear in telephone directories. Personal information shared with related corporate bodies may include your name, address, and service history.

We may analyze information about you including your calling, browsing, searching and location data on a personalized basis always in accordance with data protection legislation. We may transfer this data to authorized third parties and we may use it to tailor our (or our authorized third parties) offers, promotions, adverts or commercial communications.

We may also gather this information and statistics on aggregated basis for the purposes of monitoring the usage of the App / Website and our services and may provide such aggregate information to third parties such as advertisers, telecoms carriers, content providers our affiliated companies or prospective business partners. These statistics will not include information that can be used to identify you.

If you stop using our services or the App / Website, or your permission to use the App / Website or our services is terminated, we may continue to use and disclose your personal information in accordance with this Privacy Policy (as amended from time to time) and as permitted by law. However, if you wish us to stop e-mailing you with information in connection with the App / Website or our services, please send your request to info@streetnet.in
   
Information Security
   
  If you are aged 16 or under, you will need your parent or guardian's permission before providing any personal data. Otherwise, you are not allowed to provide us with personal information.

The internet is not a secure medium. However, we have put in place various security procedures with regards to the App / Website and your electronic communications with us, as set out in this policy.

Please be aware that communications over the internet, such as emails/webmails are not secure unless they have been encrypted. Your communications may route through a number of countries before being delivered. This is the nature of the World Wide Web/internet.

We cannot accept responsibility for any unauthorized access or loss of personal information that is beyond our control. You must not share your password which give you access to any of our services. Your passwords and any other secret information are your responsibility, and must not be disclosed to any third party.

We believe that we have appropriate policies, rules and technical measures to protect the personal data that we have under our control (having regard to the type and amount of that data) from unauthorized access, improper use or disclosure, unauthorized modification, unlawful destruction or accidental loss. Our web server is capable of up to 128bit SSL encryption. Note however, that our web server can only choose the highest common level with your browser. If you use older browsers, you may find that it only supports 40bit or 56bit encryption.

We may contract with third parties to provide certain services on our behalf. Please note that if they collect any personal data on their own behalf they would be obliged to provide you with their own privacy policy. You should review their privacy policies carefully.

All of our employees and data processors that have access to, and are associated with, the processing of your personal information are obliged to respect the confidentiality of our visitors' information.

We may need to disclose your data, if required by law or when requested to by regulatory bodies or law enforcement organizations or a court, which may use your data for regulatory purposes.
   
To Whom Will Your Information Be Disclosed?
   
  Your information may, for the purposes set out in this Privacy Policy, be disclosed for processing:

To other electronic communications service and equipment providers;
To organizations to whom we outsource services, and our business partners and associates; we will reasonably ensure that anyone to whom we pass your information agrees to treat your information with the same level of protection as if we were dealing with it;
To regulatory bodies for the purposes of monitoring and/or enforcing our compliance with any regulatory rules/codes or where required by law, regulation or legal proceedings;
To a competent authority in response to a valid, legally compliant request by a competent authority;
To our employees;
Where we, or an affiliate processing your data on our behalf, are compelled to do so by law;
To third parties from whom you have chosen to receive marketing information;
To auditors or contractors or other advisers auditing, assisting with or advising on any of our business purposes;
To insurance companies and administrators where you decide to take an insurance policy through us;
To any third party where such disclosure is required in order to enforce or apply our App / Website Terms of Use or our WiFi terms and conditions and/or other agreements, or to protect the rights, property, or safety of our company, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction;
To other affiliates of StreetNet, including their respective partners, agents and sub contractors (including prospective partners, agents and subcontractors). This may include your name, address, and service history;
To prospective sellers or buyers of our business or any of our assets;
To third party consultants, contractors or other service providers who may access your personal information when providing services (including but not limited to IT support services) to us; and In emergency situations when we have a reason to believe that someone's' physical safety is at risk;
   
Data Retention
   
  We will only retain information for as long as this is needed including for billing and for accountancy purposes. However, in certain circumstances and to comply with the applicable legislation, we may retain the information below for a minimum time of 12 months and no longer than 2 years:

Data necessary to trace and identify the source of a communication (telephone number, name and address of subscriber, sender's IP address, etc.);
Data necessary to identify the recipient of a communication (number dialed, name and address of recipient, IP address of recipient, etc.);
Data necessary to identify the date, time and duration of a communication (date of the communication, start and end time of a telephone conversation, logo-on and log-off time of internet access service);
Data necessary to identify the type of communication;
Data necessary to identify users' communication equipment or what purports to be their equipment;
Cell site data necessary to identify the location of mobile communication equipment; and Digital Subscriber Line (DSL) or other end point of the originator of a communication.
   
Your Rights Of Access In Relation To Your Information
   
  You can write to us at any time to obtain a copy of your information and to have any inaccuracies corrected. Where appropriate, you may have your personal information erased, rectified, amended or completed. Please email us to info@streetnet.in.

Please quote your name and address. We should be grateful if you would also provide brief details of the information of which you would like a copy or which you would like to be corrected (this helps us to more readily locate your data).

We will require proof of your identity before providing you with details of any personal information we may hold about you. We may charge a fee of Rs 500/- to cover the administration costs involved in providing you with a copy of your information.

  How We Use Cookies

Compliance Cookies
We will use a cookie to count how many times the cookies pop up has been shown to you. Once it has been shown to you a number of times, the pop up will no longer be displayed (unless you removed the compliance cookies from your device).

Cookies for logging in and to remember preferences
We use cookies for remembering your log in details and your preferences (e.g. if you opt out from receiving marketing communications from us).

Functional Cookies
These cookies known as Session IDs are used to enable core site functionality. They do not contain any personal information.

Analytic Cookies measuring web traffic
We make use of a tool from Google called Google analytics which tells us about the way users are using our site. This tool uses cookies to detect and let us know that someone has been to the site before, so that we know how often people return to our App / Website, how long they keep using it, and which parts of the App / Website they tend to go. We use this information to try find out how people uses our App / Website so we can improve it.

Third Party Cookies
Other companies offering and advertising their products or services on our App / Website, may also download cookies on to your equipment. These companies will have their own privacy policies which will govern the way they use their cookies. We accept no responsibility or liability for these sites to the maximum extent permitted by law.

Cookies for Adverts or logos
We may have a number of spots around the site that show advertisements or logos from other companies. We use cookies to track which adverts have been visited or which logos have been clicked.

Your Consent And Changes To This Privacy Policy
   
  By submitting any personal information to us, you consent to the use of information as set out in this Privacy Policy. We reserve the right to amend or modify this Privacy Policy and if we do so we will post the changes on the App / Website. It is your responsibility to check the Privacy Policy every time you submit information to us or place an order. By submitting further information, you signify acceptance of the Privacy Policy in place on our App / Website at such time (including any changes made to the Privacy Policy that was in place when you first signed up).

In the event the purposes for processing personal information change, we will contact you as soon as practicable and seek your consent for the new purposes where such new purposes relate to a new additional purpose for processing which is not compatible or similar to the originally specified purposes.

Use Of Your Personal Information Submitted To Other App / Websites
   
  We are not responsible for the privacy policies and practices of other App / Websites even if you accessed the third party App / Website using links from our App / Website or by means of our services.

We recommend that you check the policy of each App / Website you visit and contact the owner or operator of such App / Website if you have concerns or questions.
